Conflict resolution

Any difficulty or controversy that arises between the contracting parties regarding the application, interpretation, duration, validity, or execution of this AGREEMENT shall be submitted to arbitration, in accordance with the Arbitration Procedural Rules of the Santiago Arbitration and Mediation Center, in effect at the time of request.

The parties grant special power to the Santiago Chamber of Commerce A.G., so that, at the written request of either of them, it may appoint an arbitrator from among the members of the arbitration body of the Santiago Arbitration and Mediation Center.

The USER may revoke the appointment made by the Santiago Chamber of Commerce A.G., in which case the Santiago Chamber of Commerce A.G. must appoint a new arbitrator from among the members of the arbitration body of the Santiago Arbitration and Mediation Center.

No appeal shall lie against the decisions of the arbitrator, the parties expressly waiving them. The arbitrator is specially empowered to resolve any matter related to its competence and/or jurisdiction.
