When creating and/or registering a user on the Reqlut platform, express acceptance of these terms and conditions is required as a precondition. This means that, by accepting these terms and creating an account with us, you give your express, free, and informed consent for Reqlut to process personal data and information you provide in order to execute the various functionalities of our website.

This consent is express and written, because a digital record is kept of your account creation and acceptance. Is informed because below we explain the entire process of personal data processing and information we manage, along with your rights.

Regarding contracts signed with educational entities and recruiters with whom we share information, these terms are understood to form an integral part of those contracts.

In all Reqlut applications, platforms, and websites, we collect personal data from registered users and share it with educational entities and recruiters.

We collect all information you voluntarily provide for our services and store the information you add to your user profile.


5. What do we use your personal data and information for?

Your personal data and voluntarily provided information is used solely and exclusively to promote employability, generating professional and curriculum profiles, sending offers, creating connections with recruiters operating on the platform, generating content, networking, national and international relationships between users and organizations, promoting internships, professional and technical practices, mentoring, products and services within the community, and all other functions available on Reqlut platforms, applications, and websites.

We also share information with recruiters and educational organizations for the same purpose: promoting employability through matching with universities where students attended and with companies and recruiters seeking candidates for certain positions.


6. How long do we keep your data?

Your data will be stored for the time necessary to fulfill the purpose for which it was collected, that is, to promote the holder's employability.

The duration of the purpose will be subject to the validity of the user's account and/or the validity of the contracts through which we share information.

Notwithstanding the above, you may revoke your consent by contacting the Data Protection delegate indicated in point 3 of these terms and conditions. In such case, we will cease processing from the acceptance of the request, without the revocation having retroactive effect.


7. Should I be concerned?

Reqlut is responsible for processing your information and, as such, assumes responsibility for guaranteeing a secure environment for its users and clients. To this end, we allocate resources to strictly comply with applicable legal regulations and raise the standard of our information security management system, and thus confidentiality.

Therefore, you should not worry, but you should be informed of your rights.


8. Confidentiality.

All data processing performed by Reqlut is done within the framework of the strictest confidentiality, meaning that, except for qualified exceptions, we do not disclose or share your information with anyone.

We will only share your information if required by express legal mandate or by request from a competent authority.


9. Security measures.

At Reqlut, we are committed to ensuring information security and protecting our users' personal data. 10. What rights do you have over your personal data?

All natural persons who authorize us to process their personal data in accordance with these terms and conditions may exercise directly before Reqlut, through the data protection delegate, the following rights recognized by Chilean Law No. 19.628 and Law 1581 of 2012 and its Regulatory Decree 1377 of 2013 on personal data protection in Colombia and others that may be established:

  1. e. Revoke the consent given for data processing.
    The revocation must be express and in writing, any record or evidence of it being sufficient. The revocation form or request to the data protection delegate will be sufficient.
    The revocation will take effect from the acceptance of your request and will not have retroactive effect.
    If consent is obtained to use the data for multiple purposes, the revocation can operate independently, revoking some and maintaining others.
  2. Request access to your data
    You can send us a request to know what information we have about you in our databases.
    If you want another person to access your data on your behalf, you must attach a special power of attorney that expressly states that you authorize them to do so. That power can be simple or notarized.
  3. Request modification, update or rectification of your personal data.
    If you detect that we have an erroneous, inaccurate, incomplete or outdated version of your data in our records, you can submit a request explaining why they need to be modified and how.
  4. Request that we delete all or some of your personal data from our records.
    If you notice that the storage of your data has lost legal basis to maintain it, either because the intended purpose was fulfilled, or because you consider that they are not being used in accordance with what we committed to, you can request that we delete your information from our databases.
    Reqlut does not charge for processing and responding to these requests and will have a period of 2 business days to respond to your request, counted from the confirmed receipt. In case the complexity of the request does not allow it to be resolved within those 2 business days, you will be informed within that period about the actions being taken.

11. Who can you file a claim with if your rights are not respected?

If we do not respond to your request or respond by rejecting your petition within the deadline or in the way you wanted, you can voluntarily insist with a complaint addressed to Pablo Pumarino, privacidad@reqlut.com so that your case is reviewed again.

Likewise, you can exercise a habeas data action before a competent civil court, in accordance with the procedure established in article 16 of Law No. 19,628.


12. Limitation of liability.

Reqlut is not responsible for the accuracy of personal data provided by the holders, therefore it reserves the right to delete them if falsehood or inaccuracy is detected and to cancel the participation of that holder in Reqlut's platforms, applications and websites.

Likewise, Reqlut is not responsible for the accuracy or updating of the curriculum information voluntarily provided by the holders, this will be the exclusive responsibility of the users.


13. Dispute resolution.

In case of breach of these terms and conditions on the processing of your personal data or conflict in interpreting them, they will be subject to Chilean law.

To resolve differences, first and voluntarily, a complaint will be made directly to Tomás Cifuentes and privacidad@reqlut.com to try to reach an amicable solution.

If this is not possible, a complaint may be filed before the Ordinary Courts of Justice of the commune of Santiago, in case an infringement of Law No. 19,628, on Protection of Private Life, is alleged.

This Policy and each of its components are subject to continuous improvement and will be reviewed annually by the company. Due to its extent and complexity, this policy may be reviewed as a whole or in its different areas according to the consideration of the responsible area.


14. Intellectual property.

Reqlut SpA holds the ownership of this website. All industrial and intellectual property rights over this Internet portal are legally reserved, so access to it or its use by the user should not be considered, in any way, as the granting of any license of use or right over any asset. Users of the website may only make private, personal or professional use of its contents. The use of the website or any of its elements for commercial or illicit purposes is absolutely prohibited.

Acts of reproduction, modification, distribution or public communication of the website may not be performed without the prior written consent of Reqlut SpA. Reproduction of the website contents is prohibited, unless legally permitted and the source is cited or, failing that, written authorization to the contrary is given. In those cases where the necessary prior written authorization is produced, such authorization will replace the general prohibition mentioned above and will clearly mention the possible restrictions of use.

Reqlut SpA will not assume any responsibility derived from the use by third parties of the website content and may exercise all civil or criminal actions that correspond to it in case of infringement of these rights by the user.


15. Prohibited activities.

The following activities are expressly prohibited

  1. Sharing or providing to third parties not linked to reqlut.com and its related sites information related to access ports, access keys and user identifiers or any other information related to access permissions to reqlut.com and its related sites. Likewise, allowing access to your Private Company Menu to natural or legal persons not validated by reqlut.com and its related sites and its related sites. In this regard, the Client agrees to keep their access keys to the Service of reqlut.com and its related sites secret and not to share them with third parties.
  2. Transferring outside the platform reqlut.com and its related sites información de candidatos y su "CV" que no hayan sido previamente permitidas por reqlut.com and its related sites. Los permisos de los clientes al acceso a los "CV" de los candidatos están condicionados a la duración del Servicio y, en su caso, a la modalidad de Servicio contratada. El Cliente no podrá gestionar los "CV" de candidatos fuera del área de gestión de Plataforma reqlut.com and its related sites.
  3. reqlut.com and its related sites may block access to the platform for all third parties that do not have a collaboration agreement signed with reqlut.com and its related sites.
  4. Sending messages to candidates in bulk or for commercial, promotional or advertising purposes.
  5. Requesting candidates to register on third-party platforms without the express approval of reqlut.com and its related sites.
  6. Conditioning the continuity of selection processes initiated through reqlut.com and its related sites to the candidate's registration on a platform other than reqlut.com and its related sites.
  7. Attempting to decipher keys, systems or encryption algorithms and any other security element.
  8. Destroying, altering, disabling or in any other way damaging the data, programs or electronic documents of reqlut.com and its related sites. Performing actions that damage, interrupt or generate errors in said systems.
  9. Using reqlut.com and its related sites to attempt to access restricted areas of systems or third parties.
  10. Voluntarily introducing or linking any type of programs, viruses, macros or any other logical device or character sequence that cause or are likely to cause any type of harm to reqlut.com and its related sites.
  11. The use of web scraping tools, automatic data extraction robots, data extraction add-ons or plug-ins and similar that put the security and protection of personal data at risk in reqlut.com and its related sites.
  12. Using candidate information and resources from reqlut.com and its related sites for activities that are not directly related to the contracted service.
  13. Using multiposting tools. reqlut.com and its related sites does not allow the use of any multiposting tool that has not been expressly authorized by it. In case reqlut.com and its related sites detects such use, it will require the Client to stop using it within 30 days. In case of non-compliance by the Client with said requirement, reqlut.com and its related sites reserves the right to terminate the service without further notice, as well as not to reimburse the portion of the Services contracted but not enjoyed as of the effective date of the Service termination.

Non-compliance with any of these obligations may result in the blocking and/or termination of the Services of reqlut.com and its related sites. Where applicable, reqlut.com and its related sites may propose the preceding measures in response to acts of non-compliance with these prohibitions, so that they cease and are corrected immediately. In particular, non-compliance with the prohibition cited in section 11 may result in the automatic disconnection of the service and the consequent termination of the Services. The Client will be liable for direct or indirect damages caused to reqlut.com and its related sites and to users (clients or candidates) derived from non-compliance with any of these obligations.


16. Privacy policy.

Reqlut SpA hereby informs of its privacy policy applied to personal data. In this way, all personal data under its responsibility will be treated and the proper security and confidentiality measures will be maintained.

When a Website User registers to access and use the Website and Services, they must fill out a registration form available on the Website, in which we request data such as name, address, email address, phone, country, etc. In general, the data requested through the registration form is mandatory and necessary for the User to register as a Candidate on the Website, unless otherwise specifically established within the registration form. In the case of not providing all data considered mandatory and necessary, Reqlut may, depending on the case, not allow access to or use of the Website and Services, or not process the registration request.

El proceso de registro incluye, necesaria y obligatoriamente, que el Candidato realice y complete, a través del Sitio Web, tests y cuestionarios psicotécnicos y de fortalezas (en adelante, los "Cuestionarios"), para obtener informes generados a partir de la información completada en los Cuestionarios (en adelante, los "Informes"). Estos Informes de carácter psicotécnico y de aptitudes profesionales forman parte inseparable del valor añadido ofrecido por Reqlut con sus Servicios, en tanto en cuanto permiten al Candidato medir su valor y adecuación al mercado laboral, de acuerdo con sus fortalezas profesionales, y con ello mejorar su empleabilidad; y al mismo tiempo permiten ofrecer a los Reclutadores información muy valiosa sobre la adecuación de un Candidato a un puesto de trabajo, en el marco de un proceso de selección laboral. En ningún caso estos Informes harán referencia al perfil psicológico de los Candidatos, ni a aspectos de la personalidad que no tengan relevancia alguna desde un punto de vista profesional y laboral para empresas y reclutadores que busquen candidatos para sus procesos de selección.

Once the registration process is completed and confirmed, the Candidate will be able to access their Candidate Profile within the Website, using their username and password, and complete it with additional personal and professional information, their curriculum vitae (being able to use specific tools to extract information from it), their photograph, and/or other relevant information to use the Services. Also through the corresponding section of the Candidate Profile, the User will be able to define the privacy level of their Candidate Profile, according to the different options that Reqlut makes available to them.

On the other hand, regarding the personal data of the Candidates, including the existing data in the Candidate Profile and the results and Reports obtained from the Questionnaires that the Candidate has completed, the Candidate expressly authorizes and consents for Reqlut to provide, or may allow, Recruiters registered on the Website, access to said personal data, within the framework of a job offer or selection process, and for the purpose of managing and processing the participation of Candidates in said selection processes. The very purpose of Reqlut's Services is precisely to offer Recruiters information related to Candidates, including the results and Reports of a specific Candidate, so that both Candidates and Recruiters can benefit from the tools and added value offered by Reqlut. In this regard, in order to register and use the Service as a Candidate, the Candidate must necessarily authorize Recruiters' access to the Candidate Profile information and their results and reports.

Finally, we built reqlut.com to improve the recruitment and selection process of people, by virtue of a more transparent and more successful process for everyone. To fulfill this purpose, we encourage our Users to share true and accurate information. We also respect the industrial and intellectual property rights of others. Therefore, under this Agreement, it is required that the information published by Users be accurate and does not infringe industrial or intellectual property rights or other rights of third parties.


17. How to correct, modify or request deletion of my information.

You can request that we inform you what information we have at any time, and you can request that we modify, update or delete such information. We will ask you to verify your identity and will request certain information about your request. We also have the right to request an administrative fee to perform this service. We will process your request in accordance with the deadlines established by data protection law.

Additionally, you can perform the account deletion process automatically from your user profile. To do so:

18. Communications.

Reqlut SpA agrees that in case of sending you advertising or promotional information by email, it will contain at least the following information:

  1. Message identification, making it recognizable as advertising or promotional communication, in the message subject field.
  2. Existence of the consumer or user's right to request the cessation of sending of that type of advertising by Reqlut SpA and its obligation to suspend such sendings.
  3. A simple and effective procedure for the consumer to make that request, indicating an electronic address for these purposes.
  4. The identification of the advertiser with its trade name. In the case of teaser advertising, the obligations indicated above will be met to the extent that the agency carrying it out is identified.

Reqlut SpA will cease sending advertising or promotional messages by email or other equivalent individual communication means, to any person who has expressly requested the suspension of such sendings.

We emphasize that Reqlut SpA will send information that we believe adds value for companies and candidates to improve their work or educational performance.
